There have been many Legislative changes that impact on injured workers in South Australia

The most recent changes to legislation were passed through Parliament in July 2008. These changes have far reaching consequences for all workers who are unfortunate enough to be injured at work in South Australia.

2009 (April) Changes at a glance


As of April 1st 2009 pursuing a lump sum payment for permanent residual disability under Section 43 of the Act will be much tougher

This applies especially for those workers that have minor injuries, as there will now be a minimum threshold of 5% injury and the new guidelines drawn up by WorkCover will make it more difficult for injured workers to obtain a lump sum payment for permanent impairment.
Admittedly the unfortunate worker who suffers from a major permanent impairment will in all probability receive more compensation, however they will have to sustain significant injuries.


Work capacity reviews

A work capacity review assesses whether an injured worker is well enough to return to work or increase their earnings, either on a full-time, part-time or casual basis in suitable employment. It reviews an injured worker’s skills and capabilities to determine what suitable employment can be undertaken.
The review determines whether an injured worker is entitled to weekly payments beyond 130 weeks. It does not necessarily mean that an injured worker’s weekly payments will stop.
Under the new legislation, workers who are able to return to suitable work but who have failed to do so will no longer receive weekly payments.
Injured workers who cannot work because they are not well enough, and this is likely to continue indefinitely, will continue to be supported by the Scheme.
Workers who have returned to work to the full extent they are able to may also continue to receive 'top-up' payments.
